These Terms of Use are entered into by and between You and PrestigeMetalsGroup.com. The following terms and conditions, govern your access to and use of all Prestige Metals Group and digital activities, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.


GENERAL CONDITIONS

Prestige Metals Group, and all its subsidiaries reserve the right to refuse service to anyone for any reason at any time. The PrestigeMetalsGroup.com, content, information, services, goods, and products available on the Website are protected by copyright and other intellectual property laws.

USE OF WEBSITE

If you select the option to create an account, a user name, password, or any other secure information during the account registration process, you must not disclose to any 3rd party and treat such information as confidential. Your account is personal to you and that you are responsible for all activity that occurs through your account. You must notify us immediately if any unauthorized access to or any other breach of security occurs.

Prestige Metals Group has the authority to deactivate any user account, block access to our website, or refuse service to you at any time at our sole discretion for any or no reason, including if you have violated any provision of these Terms of Use.

ACCURACY OF INFORMATION

Prestige Metals Group reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site. Prices for our products are subject to change without notice. It is your responsibility to review these Terms periodically, and if at any time you find these Terms unacceptable or you do not have authority to agree or accept these Terms, you may not use the Site.

USER OF CONTRIBUTIONS

PrestigeMetalsGroup.com may contain product customer reviews, and other types of user generated content, or other areas or services where you or third parties may create, post, or store any content, messages, or other material on the website. Prestige Metals Group neither endorses nor is responsible for any opinion, advice, information, or statements made by third parties. Company will not be liable for any loss or damage caused by your reliance on user contributions.

FINAL WEIGHT DISCLOSURE

Our products are all handmade to order.  The weight reflected on our site is an estimate based on similar previous orders.  If the final weight is less than the estimated amount, we will refund you the difference.  If the final weight is more than the estimated amount, we will collect the difference before we ship the item to the customer.  The weight difference can fluctuate between 1 – 10 grams*

Shipping Policy

In-stock items will be shipped out within 2 business days of your purchase. All custom orders will ship within 2 business days of receipt of the final balance due. We will determine the most efficient shipping carrier for your order. All orders will be shipped with full insurance, and must be signed for by an adult. The carriers that we use are USPS, UPS or FEDEX. Due to signature confirmation for insurance coverage, we cannot ship to P.O. Boxes.

Please know that credit card authorization and verification must be received prior to processing orders. FEDEX and UPS deliveries occur Monday through Friday, however, if Saturday delivery is requested, an additional fee may apply.

Cancellation / Return / Exchange Policy

Our return policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Several types of goods are exempt from being returned. Any item not in its original condition, is damaged or missing parts for reasons not due to our error – Any item that is returned more than 30 days after delivery Refunds (if applicable) Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 3 business days. Late or missing refunds (if applicable) If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company. Next contact your bank. If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

DISPUTES

You must notify us in writing within seven (7) days after delivered goods, if you dispute any of our charges on that statement or such dispute will be deemed waived. ONLINE SALES PURCHASES:

If you wish to purchase any goods or services made available through PrestigeMetalsGroup.com website , you may be asked to supply certain information relevant to your transaction including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT METHOD(S) UTILIZED IN CONNECTION WITH ANY TRANSACTION. By submitting such information, you grant to company the right to provide such information to third parties for purposes of facilitating the completion of any transaction initiated by you or on your behalf. Verification of information may be required prior to the acknowledgment or completion of any transaction.

All descriptions, images, references, features, content, specifications, products, and prices of products and services described or depicted on the website are subject to change at any time without notice. Certain weights, measures, and other descriptions are approximate and are provided for convenience purposes only. The inclusion of any products or services on the website does not guarantee that these products or services will be available. You agree to pay all charges that may be incurred by you or on your behalf through the website, at the price(s) in effect when such charges are incurred including, without limitation, all shipping and handling charges. In addition, you remain responsible for any taxes that may be applicable to your transactions.

DESIGN FEE

There is a $250 non-refundable design fee for all custom orders, which will be applied toward the final purchase. This initial phase includes a consultation meeting and 1-2 rounds of design ideas/mock-ups. At the end of this phase and upon design approval, a 50% deposit (inclusive of the $250 design fee) based on the estimate provided for the final piece of jewelry needs to be paid in order to proceed with production. With this payment, the client agrees and approves the production of their custom piece.

DEPOSIT

All custom pieces designed or handmade by Prestige Metals Group require an approval of an estimate given and a 50% deposit. With this payment, the client agrees to allow production of the custom piece. The remaining balance will be charged upon completion of the piece. Written approval of receipt and satisfaction will be required upon receiving the piece. Jewelry will be shipped after receiving the final balance.

CREDIT CARD TRANSACTIONS

All credit card transactions are subject to a 3% credit card processing fee. Any credit card transactions greater than $1000 may require additional identity verification to protect against identity theft. Please note, bank wires will not require the additional identity verification.

RETURNS

All sales are final for custom handmade jewelry. Custom designed pieces are non-returnable.

REPAIRS

At the discretion of Prestige Metals Group, a custom piece will be repaired or replaced if any manufacturer defects are found in the first 14 days from the date of receipt. Normal wear and tear and customer abuse are not covered under this warranty.

RESIZING

It is the customer’s responsibility to provide an accurate jewelry/ring/bracelet size prior to production. Pieces will be resized on a case-by-case basis, and come with a flat resizing fee of $50 [platinum pieces require a $110 resizing fee]. Pieces such as eternity bands, intricate settings, or pieces featuring certain gemstones cannot be resized. Please allow 1-2 weeks for resizing.

CLIENT PROVIDED STONES

If a client would like to use a pre-owned stone, they must first fill out our stone intake form, send photos of the stones (or schedule an in-person meeting with Prestige Metals Group), and provide detailed information about the stone type, carat weight, any certifications (GIA, etc) and current mounting. Stone requests are approved on a case by case basis once appropriate testing and confirmation of stone authenticity has been verified. An additional fee will be charged for this service (price determined with client depending on the stone).

The client agrees that there is reasonable risk involved in removing stones from mountings and resetting stones. It is the responsibility of Prestige Metals Group to assess any risk regarding your stone, and advise the client on any foreseeable issues before moving forward with stone resetting. By providing consent for Prestige Metals Group to reset a pre-existing gemstone, the customer holds harmless Prestige Metals Group and its affiliated companies against any stone damage due to stone flaws or existing stone cracks, chipping, flaws, or inclusions. 

If a client chooses to use their own stones and ships them directly to Prestige Metals Group, the customer will select its own shipping carrier, negotiate rates, shipping terms, and remit payment directly to the shipping provider. The customer is required to purchase shipping insurance, and understands that Prestige Metals Group will not purchase shipping insurance on the customer’s behalf. The customer assumes all liability associated with this shipment, and hereby holds harmless Prestige Metals Group, its affiliated companies and all of their deemed agents against any claims for loss or damage. Any claims that need to be made for lost or damaged shipments will be the customer’s responsibility with the shipping carrier they selected.

IMAGES FOR ALL PRODUCTS

Prestige Metals Group has attempted to accurately depict the colors and details of the products offered. However, because the product and colors you see is dependent on your computer monitor, we cannot guarantee that the color and details that you see will be accurate. The products also may appear larger or smaller than their actual size depending on your monitor. Some photographs have been enlarged to show detail.

PrestigeMetalsGroup.com may contain hyperlinks to other sites and resources provided by third parties, which are provided and to be used for your convenience only. Prestige Metals Group has no control over the contents of those third party websites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of those sites or resources.

INDEMNIFICATION

YOU AGREE TO INDEMNIFY Prestige Metals Group, DEFEND AND HOLD HARMLESS THE COMPANY AND ITS LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, AFFILIATES, SUCCESSORS AND ASSIGNS FROM ANY CLAIMS RESULTING FROM YOUR USE OR MISUSE OF THE WEBSITE. You agree that the provisions in this section will survive any termination of the Terms or your access to Prestige Metals Group.


Governing Law and Jurisdiction

Any dispute or claim relating in any way to these Terms of Use or previous versions of these Terms of Use, your use of the website, or any products or services sold or distributed by company or through the website, shall be governed by and construed in accordance the laws of the Broward County State of Florida, without regard to the principles of conflicts of law.
